| BellSouth-Time Warner Create Stir with UNE Deal BellSouth and Time Warner Telecom last week announced an agreement to propose to the FCC a framework for targeted relief from unbundled network element (UNE) obligations for ILECs and requirements that carriers start reporting special access performance measures. The proposal has upset CLECs. The BellSouth press release states: "Time Warner Telecom has agreed that requiring [ILECs], like BellSouth, to offer other companies certain [UNEs] to provide services that can readily be acquired elsewhere undermines the incentive for all local carriers to invest in new network facilities. Time Warner Telecom and BellSouth will jointly ask the FCC to eliminate that requirement in certain competitive areas. For its part, BellSouth will agree to report on a comprehensive set of performance measures for its premium transport services and to urge the FCC to adopt those measures for other carriers." The proposal would remove the switching UNE for business customers and the dedicated transport UNE where three or more competitive transport providers exist in wire centers at the end of the route, and retain the requirement that CLECs use special access circuits purchased as UNEs for local service only. The framework would also subject ILECs to 11 performance measurements for special access services. ALTS
and CompTel have spoken out in opposition to the agreement. According
to Americas Network, representatives from several CLECs pointed
out that the framework was irrelevant, because Time Warner Telecom does
not use UNE-P. "It should be given as much credibility and relevance
as if BellSouth and Time Warner Telecom submitted a spectrum flexibility
proposal to the FCC," said Kevin Joseph, senior vice president of
government external affairs for Allegiance Telecom. "Its as
